Acceptance of Terms

By accessing or using Docent (the "Service"), including the mobile application and website at docentofficial.com, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. Docent is operated by Docent ("we," "us," or "our"), based in San Francisco, California.

Eligibility

You must be at least 13 years old to use Docent. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity under your account.
  • One account per person. Automated or bot accounts are not permitted.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

User-Generated Content

You retain ownership of content you create on Docent (reviews, photos, videos, tours). By posting content, you grant Docent a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, and distribute your content within the Service and for promotional purposes.

You represent that you have the right to post any content you submit and that it does not infringe any third party's rights.

Acceptable Use

You agree not to:

  • Post content that is defamatory, obscene, harassing, threatening, or hateful
  • Impersonate another person or entity
  • Upload copyrighted material you do not have permission to use
  • Use the Service for spam, advertising, or commercial solicitation
  • Attempt to access other users' accounts or private data
  • Interfere with or disrupt the Service's infrastructure
  • Scrape, crawl, or harvest data from the Service without permission
  • Use the Service for any illegal purpose

Content Moderation

We reserve the right to remove content that violates these Terms or that we determine is harmful to the community, without prior notice. We may also restrict or terminate accounts of repeat violators.

Intellectual Property

The Docent name, logo, design, and original content (excluding user-generated content) are owned by Docent and protected by copyright and trademark law. You may not use our branding without written permission.

Curator Program

Participants in the Docent Curators Program (DCP) are subject to additional program guidelines provided at enrollment. Reimbursements are discretionary and may be modified or discontinued at any time. Curator status may be revoked for inactivity or violation of program guidelines.

Paid Tours (Future)

When paid tours become available, purchases are final. Refund policies will be posted at that time. Curators who publish paid tours agree to Docent's commission structure (currently 15%) and payment processing terms via Stripe Connect.

Third-Party Links and Venues

Docent contains links to third-party websites (museum sites, ticket vendors). We are not responsible for the content, accuracy, or practices of third-party sites. Venue information (hours, admission, exhibits) is provided for convenience and may not always be current.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Venue information, exhibit dates, hours, and admission prices are provided for informational purposes. We are not responsible for inaccuracies in venue data. Always verify with the venue directly before visiting.

Limitation of Liability

To the maximum extent permitted by law, Docent shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to Docent in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Docent from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

Termination

You may delete your account at any time through app settings. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (intellectual property, limitation of liability, indemnification) will survive.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

Changes to These Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance. For material changes, we will provide notice via email or in-app notification.
